Accident Insurance for Public Transport Passengers
This Insurance is mandatory for carriers providing public passenger transport services with the starting point and final destination of the journey within the territory of the Republic of Bulgaria. Upon agreement, its territorial scope may be extended with voluntary coverage for abroad.
The insurance provides coverage for the life, health, and physical integrity of passengers in public transport vehicles and persons in their immediate vicinity when boarding or alighting.
All passenger seats in the vehicle listed on the ticket must be insured. The insurance amount is set by law at €25,564.59 per seat/passenger. The driver's seat can be insured with voluntary accident insurance.
The types of public transport for which this insurance is mandatory are:
• taxis.
• rail vehicles;
• trolleybuses and buses;
• aircraft;
• all types of sea and river vessels;
• cable cars and ski lifts;
The obligation to take out insurance arises from the date of receipt of a public transport licence or from the date of expiry of an existing insurance contract for such insurance.
Accident insurance is taken out for a period of not less than one year.
The insurance premium is determined by two methods:
•as a percentage of the revenue generated from the sale of tickets and passes for the given type of transport, or;
•as a one-off amount on the spot.
The carrier is obliged to display in a visible place in the vehicle a certificate issued by the insurer confirming that insurance has been taken out.
In the event of an insured event, the carrier is obliged to notify the insurer. The notification may also be made by the injured passenger or a third party.
The carrier is obliged to draw up an accident report for the injured passenger with a detailed description of the case. An accident report may not be drawn up if the accident is recorded in a report by a competent authority. In this case, the carrier is obliged to provide a certified copy of the report to the injured passenger
A copy or photocopy of the report shall be submitted to the insurer within 10 days of the accident.
In order to receive insurance compensation, you must be able to present the original ticket, card, or other document proving that the injured person was a passenger.
