Professional Liability Insurance for Notaries

What is Professional Liability Insurance for Notaries?
Insurance that provides protection to qualified professionals against claims made against them for financial losses suffered by clients in connection with the professional services they provide. The insurance can be taken out by an individual or a legal entity wishing to insure their liability in connection with the practice of a certain profession or the performance of a specific activity, in accordance with applicable law.

Coverage of the insurance:

  • Amounts that you are legally obliged to pay as compensation for damages or financial losses to third parties with whom you have a professional relationship in the course of your professional activities;

  • Expenses incurred with our consent to establish the occurrence and extent of potential claims and to mitigate damages, provided you acted with the due care required in the circumstances, even if your efforts were unsuccessful;

  • Expenses for your legal defense, if incurred with our consent, in the process of involving us in a case as a third-party helper;

  • Fees and court costs awarded in a compensation case filed by the claimant(s), if such compensation is payable under the terms of the policy.

We offer professional liability coverage in separate sections, intended for:

  • Notaries;

  • Accountants and auditors;

  • Lawyers;

  • Architects and engineers;

  • Private enforcement agents;

  • Persons performing cadastral activities;

  • Others.

Each section specifies the type of coverage provided: either on a claims-made basis or an occurrence-made basis.

For legal entities, we also cover the liability of persons representing you, employees under your employment, and those to whom you have assigned tasks and included in the insurance contract.

Liability limits for each insured event, and in total for all claims during the policy period, are agreed upon between the parties in the Insurance Policy and cannot be lower than the statutory minimums for the specific type of activity.

Insurance coverage under this policy applies to claims that are both first made against the Insured during the Policy Period and for which the Insured has submitted written notice to the Insurer during the Policy Period, unless explicitly agreed otherwise.

What are my obligations?

When concluding the contract:

  • To answer all questions we ask when concluding the insurance contract, providing accurate, truthful, and complete information;

  • To pay the insurance premium or the first installment if a payment plan has been agreed.

During the term of the contract:

  • To take necessary measures to prevent events that could lead to an insured event covered by the insurance contract;

  • To notify us immediately upon becoming aware of any circumstance that increases risk, and of any changes or new circumstances for which we asked written questions when concluding the contract;

  • To maintain accurate and complete documentation regarding the professional services provided;

  • If the premium is paid in installments, to pay each installment on the due dates specified in the policy.

In the event of an insured event, except in cases of factual impossibility:

  • To notify us in writing within the agreed deadlines;

  • To submit a written Notification, according to the provided form, to our office and provide the necessary documents when a claim is made;

  • To take all reasonable measures to prevent, limit, or reduce damages, as well as to clarify the extent of losses or damages;

  • Not to admit, satisfy, or reject any claims without our prior written consent;

  • To provide us with all necessary documents proving the occurrence of the insured event and the amount of damages;

  • To immediately notify us in writing if a lawsuit (claim) for damages is filed against you and to involve us in the process;

  • To notify us if you have another insurance policy covering your liability.
